DMCA Policy

Digital Millennium Copyright Act — Copyright Infringement Notice Procedures

Barbiast respects the intellectual property rights of others and expects the same from our users. In accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, we will respond promptly to valid notices of alleged copyright infringement submitted to our designated Copyright Agent.
1. Scope of This Policy

This policy applies to all content hosted on the Barbiast website, including product images, dress descriptions, graphics, logos, and any user-generated content. We are committed to removing or disabling access to material claimed to be infringing in a timely manner upon receipt of a valid DMCA notice.

2. How to Submit a DMCA Takedown Notice

If you believe your copyrighted work has been reproduced or used on our site in a way that constitutes infringement, please submit a written notice to our Copyright Agent at support@barbiast.com with the subject line: DMCA Takedown Notice – [Your Name].

Your notice must include all of the following:

  • Identification of the copyrighted work: A link to the original work or a detailed written description identifying the work you claim has been infringed.
  • Identification of the infringing material: The specific URL(s) on our site where the allegedly infringing content is located, sufficient for us to identify and locate it.
  • Your contact information: Your full legal name, mailing address, telephone number, and email address.
  • Good faith statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • Accuracy statement: A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on behalf of the owner.
  • Signature: Your physical or electronic signature.
⚠ Incomplete Notices: DMCA notices that are missing any of the required elements above may not be acted upon. Please ensure your submission is complete before sending.
3. Our Response to Takedown Notices

Upon receipt of a valid and complete DMCA notice, Barbiast will take the following steps:

Remove or Disable Access We will promptly remove or disable access to the allegedly infringing material from our website.
Notify the Content Provider We will notify the user or content provider responsible for the material that it has been removed, and provide them with a copy of the takedown notice.
Record Keeping We maintain records of all DMCA notices received and actions taken in compliance with applicable law.
4. DMCA Counter-Notification

If you believe your content was removed in error or by misidentification, you may submit a Counter-Notice to our Copyright Agent at support@barbiast.com with the subject line: DMCA Counter-Notice – [Your Name].

Your counter-notice must include:

  • Your contact information: Full legal name, mailing address, telephone number, and email address.
  • Identification of the removed material: A description of the content that was removed and its original location on the site.
  • Good faith statement: A statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification.
  • Jurisdiction consent: A statement consenting to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if outside the United States, any judicial district in which Barbiast may be found.
  • Signature: Your physical or electronic signature.

Upon receipt of a valid counter-notice, we may restore the removed content within 10–14 business days, unless the original complainant files a court action during that period.

5. Repeat Infringer Policy

Barbiast reserves the right to terminate, at our sole discretion, the access privileges or accounts of any users or vendors who are identified as repeat copyright infringers. This policy is applied consistently and in accordance with the DMCA.

6. Liability for Misrepresentation
⚠ Legal Warning: Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material is infringing — or that material was removed by mistake — may be held liable for damages, including costs and attorneys’ fees incurred by the alleged infringer, the copyright owner, or Barbiast.
