Barbiast takes intellectual property rights seriously — both our own and those of others. This policy outlines what IP assets Barbiast owns, how third parties may report infringement claims, and how we handle such claims in a fair and transparent manner.
1. Barbiast’s Intellectual Property
All original content created by or for Barbiast is our exclusive property and is protected under applicable U.S. and international intellectual property laws. This includes:
Trademarks
The Barbiast name, logo, taglines, and brand identity elements.
Copyrighted Content
All product photography, dress images, written descriptions, graphics, and website design.
Website & Software
The structure, layout, code, and user interface of the Barbiast website.
Marketing Materials
All original advertising copy, email content, social media content, and promotional materials created by Barbiast.
Unauthorized reproduction, distribution, modification, or commercial use of any Barbiast-owned content is strictly prohibited without prior written permission.
2. Respecting Third-Party IP Rights
Barbiast is committed to respecting the intellectual property rights of third parties. We do not knowingly use, reproduce, or distribute content that infringes upon the trademarks, copyrights, patents, or trade secrets of others.
If you believe any content on our website infringes your intellectual property rights, please follow the claim process outlined below.
3. How to Submit an IP Claim
To report an intellectual property infringement, please send a written claim to our IP team at support@barbiast.com with the subject line: IP Infringement Claim – [Your Name / Brand].
Your claim must include all of the following:
- Description of your IP: Clearly identify the intellectual property you own (trademark, copyright, patent, etc.) and provide registration numbers, links, or documentation where applicable.
- Identification of infringing content: Provide the specific URL(s) on our site where the allegedly infringing material appears, along with a description of how it infringes your rights.
- Your contact information: Full legal name, company name (if applicable), mailing address, telephone number, and email address.
- Proof of ownership: Evidence that you are the rightful owner of the IP in question, or that you are authorized to act on behalf of the owner.
- Good faith statement: A statement that you have a good faith belief that the use of the material is not authorized by the IP owner, its agent, or the law.
- Accuracy statement: A declaration, under penalty of perjury, that the information provided is accurate and complete.
- Signature: Your physical or electronic signature.
⚠ Incomplete Claims: Claims missing any of the required elements above may not be processed. Please ensure your submission is thorough and accurate before sending.
4. How We Handle IP Claims
Upon receipt of a valid and complete IP claim, Barbiast will:
Acknowledge Receipt
We will confirm receipt of your claim within 2–3 business days (Monday–Saturday).
Internal Review
Our team will review the claim and investigate the identified content to determine whether an infringement has occurred.
Action Taken
If the claim is found to be valid, we will promptly remove or modify the infringing content and notify you of the action taken.
Response Timeline
We aim to resolve all valid IP claims within 7–10 business days of receiving a complete submission.
5. Trademark Claims
If you believe Barbiast is using your trademark without authorization — including in product names, descriptions, or marketing materials — please submit a claim as described in Section 3, clearly specifying:
Trademark Registration Details
The registered trademark name, registration number, jurisdiction, and the goods or services it covers.
Nature of the Infringement
A clear explanation of how Barbiast’s use of the mark is likely to cause confusion or is otherwise infringing.
6. Copyright Claims
Copyright-related claims (e.g., unauthorized use of product photography, written content, or design elements) are also handled under our DMCA Policy. For copyright claims specifically governed by the DMCA, please refer to that policy for the full notice and counter-notice procedure.
7. Repeat Infringer Policy
Barbiast reserves the right to permanently terminate the accounts or access of any users or third-party vendors who are identified as repeat intellectual property infringers, at our sole discretion and in accordance with applicable law.
8. Misrepresentation & False Claims
⚠ Legal Warning: Filing a false or misleading IP claim is a serious legal matter. Any person who knowingly submits a materially false claim may be liable for damages, including legal costs and attorneys’ fees, under applicable U.S. law (including 17 U.S.C. § 512(f) for copyright misrepresentation).
